SUMMARY:INBA’s 2nd edition of Sexual Harassment Survey-2018
DESCRIPTION:“INBA’S country wide research project on the topic of  Sexual Harassment”\nThe Indian National Bar Association continues to work in their quest to build an India\, which is inclusive of the identity of modern Indian women. We seek to construct a country which is friendly towards women. With this idea\, 2017 was the most active year at INBA\, where our student volunteers worked tirelessly in order to survey about the ground realities of sexual harassment of women at work places. The statistics of women harassment cases were unbelievably steep and it was shocking to know that over 68% victims simply do not report their harassments due to the fear of consequences at work places. \nWe tend to pride ourselves in having a democracy with a constitution seeking to liberate and empower everyone. And yet\, surveys as the one of INBA on sexual harassment at work places expose the long path that we still need to walk in order to find our destination of collective gender empowerment. \nThe project report of the Indian National Bar Association\, called ‘Garima’\, conducted surveys nationally since October 2016. The initiative\, reached out to over 6\, 047 people\, of which\, 78% were women\, working in sectors such as BPOs\, IT\, education\, legal and hospitality. The interviews were conducted in over ten cities in India\, including Delhi\, Mumbai\, Bangalore and Pune. \nOver 38% women claimed to have faced sexual harassment at workplace\, while 50.7 percent said that they had been targets of harassment online. \nOur endeavour has not remained limited to data collection. Instead\, INBA has played a very important role in bringing awareness amongst genders about their rights against harassment and has sought to understand the legal provisions critically. INBA has constantly initiated the gender conversation intersectionally and brought suggestions to improve the cross sectional relationship amongst genders. \nIn the year 2018\, we look forward to continuing our project to make a difference. We shall further expand our surveys to every section of the society\, as we move out of the workplace environment. We intend to conduct surveys in schools\, colleges\, streets and neighbourhoods\, alongside workplaces. \nJoin us\, as we move to build a better India that is inclusive of every member of the society\, particularly women. \nQuestionnaire for Victim\nQuestionnaire for Witness

SUMMARY:Legislative Gaps in the Cyber ERA
DESCRIPTION:LEGISLATIVE GAPS IN THE CYBER ERA – HARMONISING INDIAN LAW WITH THE INTERNATIONAL LEGAL REGIME \nIndia is leading the global e-economy and the technological revolution but unfortunately its legal regime has often fallen short of catering to and regulating the fast evolving technological landscape and the information revolution. \nSeries of major initiatives by both\, the Law Makers (Govt. of India) and the Judiciary (Supreme Court) recognize the imperative need for developing a culture for appreciation of the issues involved with cybercrimes and the law in India. \nIndia as a country\, was the twelfth nation in the world to legislate on cyber law\, adopting an Information Technology Act\, and has also brought about certain amendments to the Indian Penal Code and the Indian Evidence Act to aid in cyber-crime investigation and prosecution. The government has made efforts towards putting in place a National Cyber Security Policy that addresses several areas related to cyber security\, particularly incident response\, vulnerability management and infrastructure security. \nCyberspace being the fifth common space\, it is imperative that there be coordination\, cooperation and uniformity of legal measures among all nations with respect to Cyberspace. The peculiar nature of cyberspace implies that existing laws are largely ineffective in curbing cyber-crime and terrorism\, thus creating an urgent need to either modify existing legislation or to enact laws that are effective in checking the growing menace online. Internet security is a global problem and cyber-crime and terrorism are increasingly becoming a worldwide nuisance. Only international cooperation will enable the nations of the world to better crackdown on cybercrime and ensure healthy development of the internet. \nSince the internet is not limited by national geographical boundaries\, its requires that any regime that is set up with regard to the internet be one that is applicable not only to a given state\, but should have global application\, anywhere on the internet. To meet this end\, it is now the need of the hour that nations of the world cooperate and make constructive efforts to reduce vulnerabilities\, threats and risks to manageable levels. Attempts that have been made so far\, including the EU Convention on Cybercrime or the OECD Guidelines and even the probable extension of the Law of Armed Conflict to Cyberspace are not without their respective glaring loopholes and deficiencies. \nThe Govt. on its part enacted the Information Technology Act in 2000 which was subsequently amended in 2008 and additional Rules were framed there under in 2011 to deal with issues relating to cybercrimes and data protection but still the law fails to catchup with the fast changing technological developments and nature of digital crime in the cyberspace.
