NOTICE TO ELECTION COMMISSION ON PLEA FOR DISQUALIFICATION OF CM NITESH KUMAR

Supreme Court today issued notice to Election Commission seeking its views on a petition against Bihar CM.

Adv. Manohar Lal Sharma and the Petitioner in the instant case demanded that Nitesh Kumar be disqualified as a legislator foe allegedly hiding his “criminal records” while filing election affidavits between 2004 and 2012. Mr. Sharma claimed through his petition that Nitesh Kumar never opted for bail in the non-bailable offence since 1991 due to his constitutional office power and succeeded in getting the police to file a closure report after 17years. Mr. Sharma demanded that the investigation against the Chief Minister be conducted afresh, he also asked for a generic declaration by the court that no person having FIR and criminal cases can be appointed to constitutional office.

The bench comprises of CJI Dipak Mishra, Justice A.M. Kanwilkar and Justice D.Y. Chandrachud sought the reply from Election Commission within four weeks.
