NO RIGHT TO USE ANY OPEN LAND ESPECIALLY GOVERNMENT LAND FOR BURIAL, DELHI HC CONFIRMED

A division bench of Delhi High Court by order dated 20/12/2017 confirmed that a person has no right to use any open land, especially government land, indiscriminately as a burial ground. The bench comprises of Hon’ble Acting Chief Justice Gita Mittal and Hon’ble Justice Hari Shankar in instant petition filed by Kabristan Intzamia Association and Ors. held that:

“Sub-Divisional Magistrate (Dwarka) has considered all matters and passed an order u/s. 133 CrPC. No illegality is pointed out or made out.”

The bench further said that all parties are strictly abide by law and order of Sub-Divisional Magistrate. Respondent in instant petition was directed to take strict action for violation of order of magistrate.

Petitioner in his petition claimed that “Premised on statement made by MLA, Petitioners have started using government land as a burial greound.”

On this petition the instant order of Hon’ble Court came in existence.
