Reversion of Promotion is not a punishment says M.P. High Court
The M.P. High Court, Jabalpur, gave a very interesting judgment in the field of promotion that if a worker is being promoted at an administrative level and the promotion made is illegal or against the service rules then reverting back of made promotion does not constitute a punishment. Thus, these types of promotion are administrative errors which can be remedied through reversion.
The petition was filed by Lakshmi Narayan Yadav, resident of Vidisha. He was basically assigned the job of attendant. Later, he was promoted to driver and after 3 months his promotion was reverted and made peon. He contended that according to MP Civil Service Conduct Rules, 1965 reversion of promotion once made comes under the provision of punishment.
The Honourable bench of Acting Chief Justice Rajendra Menon and Justice Anurag Shrivastava made clear that in these types of cases worker should not assume that his promotion has been reverted due to malpractice or any injustice has been caused to him.
